RE: The tariff classification of four women’s garments from China and Taiwan

Dear Ms. Bonvissuto:

In your letter dated April 3, 2000 and additional information submitted on May 4, 2000, on behalf of Joyce Leslie, Inc., you requested a tariff classification ruling.

You submitted four samples. Style number 4690 is a woman’s 70% acrylic, 15% wool, 15% nylon, knit sleeveless poncho-like garment that is pulled over the wearer’s head. It extends from the shoulders to below the chest but does not reach the waist. The garment features a turn down turtleneck collar and a fringed bottom.

Style number 4691 is a woman’s 55% ramie, 45% cotton, openwork crocheted sleeveless poncho that is pulled over the wearer’s head and is circular in shape. The poncho extends from the shoulders to below the waist. The poncho features a ribbed turtleneck. The bottom has a scalloped finish.

Style number 4686 is a circular shaped, sleeveless poncho that is constructed from 81% acrylic, 19% mohair, knit fabric. The garment is pulled over the wearer’s head and extends from the shoulders to below the waist. The poncho features a ribbed, turn down, drawstring collar that extends into a V-neck and a fringed bottom. The drawstring is finished with pom poms.

Style 4687 is a woman’s poncho-like pullover sweater that is constructed from 59% acrylic, 26% nylon, 15% wool, knit fabric. The outer surface of the sweater measures less than 9 stitches per 2 centimeters in the horizontal direction. The garment is rectangular in shape with a ribbed turtleneck collar. The sides of the garment are permanently sewn together forming cape sleeves.

The applicable subheading for style 4690 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of manmade fibers: other: other: women’s or girls’. The duty rate will be 15.4% ad valorem.

The applicable HTS subheading for style 4691 will be 6102.90.9030, which provides for women’s overcoats…capes...and similar articles, knitted, other than those of heading 6104: of other textile materials: other: other. The duty rate will be 5.9% ad valorem.

The applicable subheading for styles 4686 will be 6102.30.2010, which provides for women’s overcoats…capes…and similar articles, knitted, other than those of heading 6104: of manmade fibers: other: other. The duty rate will be 28.9% ad valorem.

The applicable subheading for style 4687 will be 6110.30.3020, which provides for women’s sweaters, knitted: of manmade fibers: other. The duty rate will be 32.9% ad valorem.

Style 4670 falls within textile category designation 659; style 4691, 835; style 4686, 635; and style 4687, 646. Based upon international textile trade agreements products of the China and Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
